ms2k Career Management - Breach of Contract

My name is Anonymous Rex an alias. I am using an alias because, as a Consultant, outing a former client for Fraud online isn't the best public relations or referral for future business.  I can assure you that everything written below is factual, truthful and documented.

I was hired as an Outside Consultant, aka Independent Contractor, by Moumouni Sere aka Mouni Sere CEO and Founder of ms2k Career Management a Recruitment and Staffing Company for the Hospitality and Health Care Industries located in Queens, NY.  The company, founded and incorporated in March 2006, recruits and places candidates through the H2B and J-1 Visa programs.

Mr Sere is a one man operation working from his home. He hired me to work from my home with the intention of helping him grow the business to the point where additional staff would be hired and outside office space would be secured.

My hiring was done online and over the phone as Mr Sere had responded to a Situation Wanted ad I had posted online.

A 30 day contact was mutually signed, copies faxed back and forth, calling for me to earn "X" dollars per hour for a documented 35 hours per week of work.  Payment to be made by check twice a month commencing Wednesday of the Third week and every two weeks thereafter.

When Wednesday of  the Third week arrived the scheduled payment was not forthcoming. However, Mr Sere agreed to meet me that Saturday, in person, to give me my check, midpoint between our residences. This was the first and only time I've had any personal contact with him.  The company check I received was for less than 10% of my first two weeks earnings not the full two weeks earnings he was legally obligated to pay.

Mr Sere promised that by week Five, two weeks later, the company would have the funds to pay me my back earnings for weeks one and two plus pay me my current earnings for weeks three and four as certain Accounts Receiveable would be forthcoming. Those funds would be used to pay me.

At the end of the workday on Friday of week Four, 6 days after meeting Mr Sere in person and after 5 additional days of work, I reminded Mr Sere that he would have to pay me four weeks earnings that following Wednesday.  He claimed the company had no money to pay me.  He claimed that certain Accounts Receiveable had not been received.  He said he couldn't pay me as contractually agreed on the next Wednesday or even knew when he would be able to pay me after that date. He said he'd have updated news about paying me over the weekend and that he'd call me to discuss the matter by Sunday night.

No weekend call to me was ever made.  On Monday morning of Week Five I told him verbally over the phone and reconfirmed the conversation via e-mail that I was resigning retroactive to the previous Friday and that I expected the balance of my four weeks earnings by 1 pm on that Wednesday.  I told him he had Breached the Contract by not paying me as agreed.

Mr Sere told me he couldn't pay me and then claimed payment was conditional on certain company objectives having been met.  When I pointed out that the Employment Contract clearly states, “ payment is 'X' dollars per hour for a 35 hour week” with no conditions attached he got silent and then hung up the phone.

It is obvious that Mr Sere has no intention of honoring a Written Contract.  It is obvious that Mr Sere has no intention of ever paying me for the 140 hours worth of services rendered during the four weeks I worked with him.

ms2kCareer Management has been in business for more than 5 years. Am I to believe that the company contractually hired me knowing that it had no money to meet Payroll? Am I to believe that the company contractually hired me knowing that 3 weeks after hiring when my first paycheck was due there would be no money? Am I to believe that the company contractually hired me knowing that 5 weeks after hiring when my second paycheck was due there would be no money? Am I to believe that the company has no lines of credit or cash reserves to meet debt obligations or Payroll?

<>I believe that Mr Sere knowingly hired me with the intent of not paying me in full.  I believe Mr Sere is deliberately and systematically funneling money out of his company for persoanl use and/or into his personal or family bank account so that he can "legitimately" claim that his company has no money to pay me.

Makes you wonder who else he has stiffed in the past and who else he will stiff in the future!

Business owner called me today to offer me the opportunity to continue the work relationship.

Does he have the money to pay me for 4 weeks back Salary? NO!

Does he know when he'll be able to pay me in full the four weeks back Salary? NO!

Yet, he expects the opportunity of WORKING FOR FREE to be an incentive for me to come back to work for him.

He was shocked when I told him NO! Just pay me my money!

Moumouni (Mouni) Sere and ms2k Career Management as co-defendants have been issued a Summons to Appear in NYC Small Claims Court. Mr Sere will have to explain to the Court why he and his company Breached a legal binding Written Contract.

This is a warning to all clients and candidates who would do business with Mr Sere and ms2k career management.

He and his company do not honor written contracts.

Would you as a client or candidate sign an agreement with Mr Sere and ms2k knowing the above facts?

It is now 7 days since Moumouni Sere and his company ms2k Career Management have been issued a Summons as co-defendants to appear in NYC Civil Court to answer my complaint of Breach of Contract.

It is now 55 days since the signed Contract commenced, 38 days since the first pay check was due in full per the terms of the Contract, 24 days since the second pay check was due in full per the terms of the Contract.

Have the defendants made any attempt to resolve their Breach of Contract? NO

Do I expect the defendants to voluntarily resolve the matter satisfactorily prior to the Court date? NO

Do I expect the defendants to tell the Judge on the Court date which will be months after the Contract was signed that the company still has no money to pay me? YES

Do the defendants deserve the public scrutiny, embarrassment and humiliation of being outed as violators of a signed Contractual Agreement? YOU BET!

As an Employer or Job Candidate beware of any individual or company that does not honor signed contracts.

JUNE 1, 2011 UPDATE -- ms2k Career Management and Moumouni (Mouni) Sere STILL REFUSE TO HONOR A WRITTEN CONTRACT

Today is June 1, 2011. Court date still in the near future.

Moumouni (Mouni) Sere signed a legally binding Employment contract with me, as an Independent Contractor, a contract he created and enforceable under NYS Law, 73 days ago. He breached the contract for the first time 56 days ago by failing to pay me on time and in full my first two weeks salary. He breached the contract for the second time 42 days ago by failing to pay me on time and in full my third and fourth weeks salary. To date he has paid me less than 10% of our contracted agreement and that was 53 days ago.

I called Mr Sere today and asked him where was the rest of my money. Received the now tired refrain: "The company has no money". "I don't know when I can pay you". "As soon as I have the money I promise to pay you in full." etc, etc.

Can't wait for him to tell the same unbelievable story to the Court. As if the Court will even remotely believe him.

A Contract is a contract. Don't like the terms then don't sign. (Again, he wrote the contract!)

EMPLOYERS & CANDIDATES BEWARE!!

Mr Sere and his company ms2k Career Management do not honor written contracts. You would have to be a fool as an Employer or paying Candidate to expect to get any level of professional service from this man and his company.

If he won't honor a written contract with me he won't a written contract with you.

MS2K CAREER MANAGEMENT UPDATE!

Today is June 8. Called Mr Sere and asked him, "Where is my money?". He immediately hung up.

It is 80 days since a legally binding contract signed by Mr Sere commenced. It is 63 days since the contract was breached by Mr Sere for the first time. It is 49 days since the contract was breached by Mr Sere for the second time.

Clearly THESE ARE NOT THE ACTIONS of an INDIVIDUAL or COMPANY INTENT ON ABIDING BY THE CONDITIONS LISTED IN A LEGALLY BINDING CONTRACT.

I look forward to winning a NYC Civil Court Judgement against Mr Sere and ms2k Career Management for Breach of Contract. I look forward to having that Judgment executed as I expect Mr Sere and ms2k Career Management to ignore the Judgment against them once issued.

After a 4 month wait for trial in Queens County NY Civil Court ms2k jobs, ms2k career management, Moumouni Sere aka Mouni Sere (Founder and CEO) were found GUILTY of BREACH of CONTRACT.

Officially they are JUDGEMENT-DEBTORS. Judgement is good for 20 years.

Mr Sere had 4 months to voluntarily resolve the matter and abide by the terms of a Contract he authored and co-signed. It was not surprising that he failing to appear in Court last night to defend himself and his company.

I fully expect the need to engage the Court's full resources in order to execute the judgement.

WARNING to ALL EMPLOYERS and JOB SEEKERS:

ms2k jobs, ms2k career management, Moumouni Sere aka Mouni Sere are all JUDGEMENT-DEBTORS having been found GUILTY of BREACH of CONTRACT.

You should file a complaint with the District Attorney and State Attorney General. The actions you have described are borderline criminal if not outright criminal. At this point in time the intent to ever voluntarily pay you and to honor the terms of the contract are not there. Was there criminal intent to defraud from the very beginning? That will be up to the authorities to determine.
